....the comments from the anti-Gay marriage group can be summed up in one sentence..."The courts must reaffirm the will of the people".

This is exactly what the courts must NOT do...not if we are to abide by the Constitution...that´s why these kinds of topics should not be open to popular voting....they have to be decided by the Constitution..which itself depended on the popular will of the people...but, once instituted it meant that the Judicial branch must pass on the constitutionality of any law..no matter how popular that law.

The Constitution can be changed..it´s been done over 20 times...things can be added, taken away or tweaked...but it takes more than a popular majority to do that...so majority rule cannot trump the Judiciary´s role..it can amend the Constitution, if you get three-quarters of the States to go along...but a mere majority won´t do.

Until the Constitution is changed it is the sworn duty of justices to uphole the Constitution, not popular will...not popular laws.

Judges are not being "activist" when they uphold the Constituion, regardless of popularity...they fail in their duty when they bend to the popular will.

These Christian organizations are setting the stage for the day when they can command a simple majority and then force onto the rest of us their Christian nonsense...it is a POLITICAL move hiding behind Jesus...and to make it work they have to convince us that our Constitution really meant to say that the majority can do whatever it wants, whatever is popular with its members.
